Q&A SUCCESSFULLY DEFENDS AND RESOLVES A DISPUTE OF NON-CONTRACTUAL COMPENSATION FOR DAMAGE, PROPERTY RECLAIM, AND PROPERTY RELOCATION DEMAND AT THE APPELLATE COURT OF LONG AN PROVINCE

 

Attorney Nguyen Quoc and Attorney Nguyen Thanh Hai acted as Lawyers of the Client, who was the Defendant in a dispute involving non-contractual compensation for damage, property reclaim, and property relocation demand at the Long An People's Court appellate court.

 

In the first-instance trial at the Duc Hoa District People's Court, the Trial Panel accepted the Plaintiff's claim and ordered the Client to compensate for damages amounting to over 3 billion VND (equivalent to 118,460 USD). However, after consultation was provided and the case files were thoroughly reviewed by Q&A's legal team, several serious procedural violations affecting the Client's legitimate rights and interests were discovered.

 

On April 24, 2024, with the participation of Q&A's legal team at the appellate trial of the Long An People's Court, Attorney Nguyen Quoc, with sharp arguments and clear legal grounds, made every effort to protect the legal rights and interests of the Client. This appellate commercial trial had numerous procedure violations from the first-instance trial, resulting in prolonged trial time. At the end of the trial, the court annulled the commercial judgment of the Duc Hoa District People's Court, as requested by the Client. The case files were then transferred to the Duc Hoa District People's Court for re-trial according to the first-instance procedures.
